The Demise of the 28-Clause Peace Initiative for Ukraine: Why Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the crisis caused by the announcement of a new 28-point plan for ending the war appeared – briefly – to have been contained. A senior US official spoke of "substantial progress" after Ukraine-US talks in Geneva. On Monday night, Russian leadership made its retaliation: an extensive attack of rocket attacks on Kyiv.

The Rhythm of Negotiation and Warfare

The succession of opposing developments captured the bleak nature of the outgoing year. By day, diplomatic battles are fought: hopeful statements are released from multiple capitals. Significant resources is expended on managing certain initiatives. By night, the Kremlin brutally reminds the world that, for them, military action persists as the primary tool for achieving "settlement".

Nighttime Reality

As the offensive developed into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was exposed. Ukraine is equipped to monitor missile launches from enemy soil, a ability afforded by up-to-date information. From witness perspectives, Ukrainian air force fighter jets that had been deployed to engage hostile aerial threats roared overhead – sophisticated military planes supplied to Ukraine by Western partners.

Shortly after, Kyiv's anti-aircraft weapons engaged: multiple launches deployed against a Russian ballistic missile. This was a sophisticated defense system at work, probably supplied through allied countries. Every launch jolts you unexpectedly, causing tremors. The instant of fear quickly transforms into grim resignation: possibly the approaching threat won't cause damage this time, sparing the city from devastation and additional electricity failures.

Continuous Dangers

Following this, a heavy machine gun engaged a aerial vehicle close by, part of a rapid response unit – most likely Western-made equipment. Sadly, the shots failed to hit the enemy aircraft – it continued its flight toward its objective.

With pauses, this carried on until dawn. Kyiv greeted the daybreak reports: multiple fatalities, devastation and infrastructure problems in numerous residences as a result of the night's assault. As typically, everyone still went about their day – enduring hostilities. But those entire period illustrated Ukraine's critical military reliance on international aid – a reliance that regional partners are evidently unprepared to replace in the near term.

Unsuccessful Negotiations

The 28-point plan from Washington provoked deep reactions, debate and deep concern – and momentarily shifted focus from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after earlier high-level meetings and bilateral conferences.

Every new approach from US leadership follows the identical sequence: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, effectively counters. They contain the crisis but never actually achieve victory. This pattern will, certainly, endure.

Strategic Calculations

It is convenient to criticize specific actors of repeatedly advocating Kremlin's demands. But that does not seem to be the entire situation. American leadership operates on a premise familiar among experienced diplomats: you cannot win at the negotiating table what you have failed to defend militarily. The American government presumes that it is impossible to force Russia to relinquish the land that it presently holds in Ukraine's southern or eastern regions.

The challenge is that while recognising this factual reality, US leadership does little to prevent Kremlin actions, through words or deeds, from thinking that the situation will not evolve additionally in its advantage in the months ahead.

Conflicting Perspectives

Therefore, Russian leadership is certain that time is on his side – that Ukraine and its partners are coming close to fatigue. Their reason to accept conditions that does not give them the largest achievable advantage is virtually nonexistent. There may be multiple initiatives to stop fighting, but they will continue as long as Russia's government remains supremely confident in the outcome.

On the contrary, Kyiv believes that Ukraine can still hold out, gradually sacrificing people and territory but averting a complete military breakdown until situations evolve in its favour.

Existing Situation

Factually, there are no real preconditions for a ceasefire. Now, individual motivations are becoming relevant: leadership ambitions to broker a ceasefire and obtain worldwide acknowledgment, and Ukrainian leadership's double obstacles – on one hand, not to alienate a key ally, and on the other, to mobilize citizens around the country's interests against any proposal Kyiv finds unacceptable, so that their priority does not switch to domestic problems. And although their task will now be significantly challenging after recent developments, it remains highly unlikely that this will alter their fundamental strategy.

These two forces are influencing discussions.

Summary and Prospects

It took a mere seven days to eliminate the 28 points of the latest plan. Assertive and inconsistent approach of the matter by US administration, pushback by Ukraine and the rest of Europe, along with pacifying measures of diplomats, and finally, current information leaks, all achieved their purpose.

While new proposals based on previous concepts are imminent, Kyiv, London and other allied nations should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are founded on Moscow's terms and reflect certain reluctance to alter the situation, if they stand together and improve their protective measures at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the predictable period, primarily depend on ongoing international assistance.
